Terms and Conditions
Please read the Terms and Conditions carefully as lack of knowledge thereof cannot be grounds for a complaint. Building joinery includes windows, sliding walls, shutters and front doors made of wood, combinations of wood and aluminium and/or synthetic materials.
1. QUOTE VALIDITY
A quote is considered valid within the scope of the positions, quantities, descriptions and other elements that are constitute the quote. Issuance of a new quote fully cancels the previous one. The customer guarantees the accuracy of the data required to draw up the quote. The quote is valid and binding for Jelovica, d. o. o. (hereinafter referred to as the company) only within the validity period stated in the quote.
2. MEASUREMENTS
The company is responsible for the suitability and accuracy of joinery dimensions if the customer orders the joinery based on measurements carried out by engineers – surveyors or authorized representatives of the company – and receives a quote that includes installation. Exact positions and openings of the joinery are determined during the measurement and are stated in the measurement sheet and in the final version of the quote. The customer must inform the seller or installers of any obstacles (hidden installations, plumbing, electrical wiring, etc.), otherwise, they bear the costs of any damage to such installations and delays in installation.
At the time of taking measurements, the customer or their representative must be present and the installation details agreed upon, as they form the basis for drawing up the final quote.
3. PRICING AND PAYMENT TERMS
The prices of the company are considered net prices excluding taxes, inclusive of standard product packaging. The company reserves the right to change prices if the quantities, descriptions or positions constituting an integral part of the quote are changed. It also reserves the right to change the construction of windows/doors/blinds due to construction factors – i.e. technical details or technical regulations.
Payment terms for retail customers:
- 50% advance payment in the form of an interest-free advance, the remaining 50% prior to shipment/installation;
- 100% advance payment in the form of an interest-free advance;
- 100% irrevocable bank guarantee;
- In case of sale offers, sale discounts shall apply;
- Discounts cannot be combined;
- The customer pays the purchase price to the Jelovica d.o.o. bank account, and for the purpose of transfer or reference the reference number of the current offer shall be indicated on the payment instructions.
Until the final payment is made, the goods remain the property of the company and are not dispatched from the warehouse.
Payment terms for wholesale customers are agreed under the applicable contract.
VAT RATES:
- 22% – general rate;
- 9.5% – for residential construction (for natural persons – Slovenian citizens with a building in Slovenia, who make a purchase that includes installation; this means the installation of doors and windows in the buyer’s residential building – unbound, the customer proves this with the following statement to the seller: Declaration for 9.5% VAT: I declare that I am the owner of the residential premises and that the above ordered building installations will be installed in the residential premises at the installation address. The property is intended for long-term residence. VAT amounts to 9.5% because the installation will be performed by Jelovica okna, d. o. o., or its authorised subcontractor (ZDDV and the rules on VAT – Official Gazette of the Republic of Slovenia, No. 13/11 – official consolidated text, 18/11, 87/11, 38/12 and 83/12)
- For legal entities making a purchase that includes installation, the VAT invoice shall be passed on to the customer on the basis of reverse charges under Article 76a of ZDDV-1.
4. ORDER
The submission of an irrevocable bank guarantee or payment of a partial or total advance is the final confirmation of the order by the customer. It is also understood that the customer is familiar with the content of the quote, terms of sale and Terms and Conditions and agrees with them. The Terms and Conditions are publicly available at all Jelovica points of sale, service centers and at www.jelovica-okna.si.
5. DELIVERY PERIOD AND DELIVERY
The delivery period is stated in the quote and begins:
- Three (3) working days after the advance payment is received in the transaction account of the company;
- When all the technical data necessary for the manufacture of the doors and windows is known.
Any changes must be communicated in writing within 3 working days after the advance payment. Delivery time will then be adjusted accordingly. Delivery times do not apply during collective leave.
Takeover of goods: If the customer does not accept or allow installation within one month of being notified that the goods are ready, storage fees of 1% of the value of goods may be charged on a weekly basis. Goods can be picked up Monday to Friday from 7:00 to 15:00, with at least one working day notice. Goods must be inspected upon takeover. Afterwards, they cannot be exchanged or returned. If joinery is installed by the customer, they cannot claim defects resulting from improper installation or damage during handling.
6. ADDITIONAL WORKS
Any unforeseen additional work is charged separately (delivery time is extended accordingly).
7. TRANSPORT OF JELOVICA PRODUCTS
- If the total sum for the installation amounts to at least €164.25 (or €183 with 22% VAT) or if the value of the net order without installation is higher than €2,000.00, the customer is entitled to a one-off free delivery within Slovenia by road that permits transport with a freight vehicle, the total weight of which does not exceed 3 metric tons. If additional transport is required at the request of or through the fault of the buyer, it shall be charged according to the applicable price list of the company;
- If the lower purchase limit is not reached, transport for each additional kilometre from and back to the nearest BSC (Business Service Centre) to the customer will be charged at €1.00/km. The customer is obliged to unload the products from the vehicle (van or truck);
- Transport means that the company delivers products to the facility, and the customer is obliged to unload the products and take into account the nature of the order (e.g. heavier and larger products require more people when unloading and handling);
- The transport of the products shall be carried out according to a pre-arranged schedule coordinated between the customer and the seller.
8. INSTALLATION AND DISMANTLING
The installation date is arranged once the joinery is produced.
To allow for uninterrupted installation, the customer must do the following by the date of the installation:
- Ensure access and openings for the smooth installation of doors and windows;
- Protect the property within the building, protect the flooring and insure the building;
- Define at what depth from the outer edge of the wall the windows are to be installed;
- Provide access to where the works will be carried out, basic protection and electricity;
- Determine where the left and right windows are to be installed;
- For measurements in a new construction, provide information on the elevation of the finished pavement (meter ris or vagris);
- In case of work at heights, where the installation cannot be carried out from the ground, the customer must provide a structure that allows for safe work;
- In case of work at heights, the customer is obliged to inform the seller in advance (at the time of ordering), for it is necessary to agree on the method of installation and arrange for the platform or order a lift;
- In the event that there is a carpark or similar around the facility, the customer must ensure that during installation, cars or other property are taken away from under where joinery is to be installed in order to avoid material damage due to possible falling material during installation or dismantling;
- Installation on facilities where safety is not addressed (fences, stairs, etc.) shall not be carried out.
Dismantling and additional works
If dismantling and additional works are not specifically stated in the seller’s quote, they shall not be carried out. Dismantling includes the dismantling of existing doors and windows. When replacing old windows and the old frames are cut out, the company is not responsible for damage to the surrounding window structure. Remediation of possible damage to the external surrounding wall and the wall assembly, which may occur during dismantling due to deterioration of the wall assembly or special installation methods, is not the subject of this quote and any repairs to the plaster and wall assembly are carried out by the customer under their own arrangements. The quote also does not include the transport of old windows to a disposal site. At the customer’s request, we can include all these works in the quote, charge them and carry them out professionally.
Installation includes the delivery and installation of windows and/or doors in prepared wall openings according to the installation details prescribed by the manufacturer with the necessary material according to the type of installation. Installation does not include the disassembly of old windows, works on the surrounding wall structure, joinery, masonry or painting. It also does not include the installation of finishing strips, sills, exterior roller blinds, venetian blinds, etc.
In the case of installation according to the RAL guidelines, sealing of gaps should be according to the “inside more thoroughly than outside” system. Sealing is triple layered, consisting of an internal vapour-impermeable barrier, an external vapour-permeable barrier and a central thermal and sound insulation barrier. We use different systems for the implementation of RAL installation depending on the situation.
Where the seller or their authorised contractor does not perform the installation of the doors and windows, the seller does not give a guarantee related to the installation, irregularities, damage or the use of fixtures and fittings.
Floor skirting in the rooms is installed after the installation of the frames.
Where the customer also orders finishes on the interior surrounding wall structure, these do not include painting works (included are plasterboard work and the initial rough layer of putty; not included are sanding, further application of putty and whitening).
In the event that the installation of the ordered elements at the customer’s request takes place in two parts, the customer is charged the additional transit costs and the invoice is issued separately after the installation of the first part and before the installation of the second part. Risk of damage to the parts that are in this case stored by the customer is borne by the customer themselves.
9. INSPECTION AND HANDOVER
At the beginning and end of the installation works, the customer or their representative must be present at the facility. By signing the handover record, the customer confirms that the goods have been accepted without any faults or defects. If the customer comments on the products and/or services, the comments must be noted in the handover record. In the event that the customer is not at the facility at the completion of the installation and does not sign the handover record, the goods shall be deemed to have been accepted and installed without defects.
10. SERVICING AND MAINTENANCE
Repairs to the doors and windows within the warranty period may only be carried out by the company’s professional or by an authorised service technician, otherwise the warranty shall be terminated. All products by the company must be inspected every two years and, if necessary, properly and professionally repaired with original parts. Paid-for servicing is performed by the company’s service technician or an authorised service technician. Each service intervention must be entered on the warranty card. Only with a completed warranty card can the entire warranty apply to all products.
Maintenance of external doors and windows and materials becomes the customer’s responsibility after the handover of products. Maintenance and adjustment of windows after installation is not included in the quote. Maintenance cannot be the subject of a claim.
11. CE MARK
The manufacturer, i.e. the company, ensures that its products are manufactured under the conditions prescribed by the CE mark standard.
12. FINAL PROVISIONS
We reserve the right to amendments and errors in our brochures, catalogues, price lists, sketches, drawings, calculations and similar documents.
All technical details, as well as samples, brochures, catalogues, sketches and the like, remain the intellectual property of the seller and are legally protected as regards to their reproduction and use.
The Terms and Conditions apply from 13 March 2018 until cancellation.
